The Ontario Court of Appeal agreed to schedule on an urgent or expedited basis, the appeals by the City of Windsor and Town of Tecumseh of the recent decision by the Superior Court of Justice to restrict their communications concerning the opt-out period currently underway in the bingo class action.
The plaintiffs in the case have also indicated their intention to appeal the Superior Court decision on an expedited basis.
The appeals before the Ontario Court of Appeal have now been scheduled to be heard on February 25, 2016 at Osgoode Hall in Toronto.
The court order that is being appealed does not permit public comment by Windsor or Tecumseh about the Opt Out Campaign, other than existing communications remaining in place.
The City and Town will continue to abide by the Court’s order unless it is varied or set aside as a result of the appeal.
The city says there will be no further comment made on this matter at this time.
